Legal Requirements

Every property marketed ‘for sale’ requires an energy performance certificate (EPC); At Home Property can source this legal requirement for you with no delay to the marketing of your property.

Guide To Selling

Step 1: Accurate valuation

Your aim should be to sell your property at the best possible price in the shortest possible time. Our expert knowledge of the market place gives us an intimate and detailed knowledge of property values in your area. We want you to achieve your goal of selling – not to simply list your property which is why we interest in your home straight away which will provide you confidence you have chosen the right agent to market your property.

Step 2: Selecting an estate agent

When choosing an estate agent to represent you consider their opening hours, when they will be available to conduct viewings, their high street presence and what kind of marketing your property will receive. These are critical to obtaining the maximum exposure and price for your property.

You should also check if your agent will organise your government-required Energy Performance Certificate on your behalf or if you need to arrange this yourself? At Home Property can arrange this for you. You must have commissioned an EPC before your property can be marketed.

Step 3: Instructing a solicitor

The successful sale of your property can be reliant on the instruction of an efficient and experienced solicitor. It is a good idea to do some research and make a decision before you put your property on the market as this will help to avoid delays.

We can offer recommendations if required, to ensure your motivation to sell is matched by your conveyancer.

Step 4: Presenting your property

First impressions count, making the presentation of your property critical to a successful sale.

Consider addressing any DIY jobs you have been meaning to get done, add a fresh coat of paint where necessary and try to de-clutter to make rooms appear larger.

At Home Property team will then take quality photographs, produce floor-plans and write comprehensive property description of your home and surrounding area. At Home Property can also offer ‘professional photography’ of your home if you decide that is an service you wish to use – speak with us for more detail.

Step 5: Marketing your property

To find your perfect buyer you need to give your property maximum exposure across a wide range of media.

When you At Home Property you will automatically benefit from a comprehensive marketing package, including: exposure on our mobile friendly website, portal coverage via Rightmove and Zoopla, sales details, PR via our social media network, press advertising where appropriate and email and SMS alerts to our registered buyers.

Step 6: Accompanied viewings

At Home Directors provide a personal and flexible service and we know that many buyers require bespoke viewing times. Working to ensure no opportunity is missed to sell your home our longer opening hours and willingness to accommodate viewings where every possible to suit your potential purchasers are essential to maximise viewing opportunities for your property - in fact 50% of our viewings are carried out after work and at weekends. Accompanied viewings also mean we can use our expertise to help sell your property.

Utilising a web based software service our phone lines and email will divert to the mobile of a team member anytime, ensuring we can every enquiry about your home.

Step 7: Receiving an offer

As soon as an offer is received we will notify you both verbally and in writing.

Any special conditions of the offer will also be stated in writing and we will check the buyer's ability to proceed before you decide whether to accept the offer.

Step 8: Offer agreed

Once you accept an offer we will do the following:

  • Prepare a memorandum of sale
  • Write to all parties to confirm the agreed price
  • Ask you to confirm your solicitor's details

Your solicitor will send out a draft contract to the buyer's solicitor who will then carry out preliminary enquiries. At this stage you will also be able to agree on dates for the survey on your property, exchange of contracts and proposed date for completion.

We will advise you and negotiate on your behalf throughout this process, keeping you informed every step of the way.

There are no legal obligations until contracts are signed.

Step 9: Exchange of contracts

Exchange of contracts occurs when the following have been confirmed and agreed:

  • Preliminary enquiries following receipt of draft contract
  • Evidence of a good title
  • Specific issues highlighted in the Lease, if applicable
  • Local search queries
  • Fixtures and fittings to be included in the sale
  • The buyer's mortgage offer

Once the contract has been signed by both parties the deposit (usually 10% of the purchase price) will be telegraphically transferred or paid in the form of a banker's draft by the buyer's solicitor to your solicitor. The completion date is then set by mutual agreement.

Step 10: Completion

Completion is when the residual monies (usually 90%) are transferred from the buyer's solicitor to your solicitor's account.

Your solicitor will call you when the money has cleared in your account and will inform us to release the keys.

Congratulations, your property is now sold!

Step 1: Arranging your mortgage

Before you begin your property search it is advisable to arrange your finances and, if required, have a mortgage agreed in principle. This will confirm how much money you have to fund your purchase which will ultimately influence your property search. It will also demonstrate to a vendor of a property your motivation and that your are serious about buying.

Our recommended mortgage broker has access to the entire market, as well as exclusive deals and rates to help find you the best mortgage available. Please speak to us for further details.

In order to secure a property we recommend an early viewing. We will meet you and accompany you throughout so that we are on hand to answer any questions immediately and advise where necessary.

Step 5: Instructing a solicitor

The successful purchase of a property can be reliant on the instruction of an efficient and experienced solicitor. It is a good idea to use a solicitor who knows the area that you’re moving to and specialises in conveyancing.

We can recommend a local solicitor, who knows the local area and can see you face to face, that will be as motivated to achieve a successful purchase as you!

Step 6: Making an offer

Once you have identified a suitable property we will put your offer forward to the seller both verbally and in writing stating any special conditions of the offer. You may need to demonstrate, if requested, that you are able to proceed (e.g. provide evidence of your mortgage agreed in principle). Please don’t be offended, its an important decision as well for the seller; if you were selling a property you would want to know that your buyer had the necessary funds before accepting an offer.

There are no legal obligations on either side until contracts are signed.

Step 7: Offer agreed

Once your offer is accepted we will prepare a memorandum of sale, write to all parties to confirm the agreed price and ask you to confirm your solicitor’s and mortgage broker’s details.

You will now need to instruct your solicitor to proceed with the conveyancing process and your mortgage broker or bank to proceed with your application.

Step 8: Conveyancing

As part of the conveyancing process your solicitor will do the following:

  • Raise any enquiries on receipt of the draft contract from the seller’s solicitor
  • Request local searches
  • Refer to the information already provided in the seller’s Home Information Pack
  • Agree on a date for exchange of contracts

We will assist your solicitor and negotiate throughout the process, keeping you informed every step of the way.

Step 9: Mortgage Valuation and/or Survey and mortgage offer

A mortgage valuation and/or survey of the property will be booked by a surveyor on behalf of the mortgage lender to identify any structural problems and advise on the property’s value.

After the mortgage valuation report is received, a formal mortgage offer will be sent to you and your solicitor which you will need to sign before it is returned.

There are no legal obligations until contracts are signed.

Step 10: Exchange of contracts

Exchange of contracts occurs when all enquiries have been confirmed and agreed.

Once the contract has been signed by both parties the deposit (usually 10% of the purchase price) will be telegraphically transferred or paid in the form of a banker’s draft from your solicitor to the seller’s solicitor.

The completion date is then set by mutual agreement.

Step 11: Completion

Completion is when the residual monies (usually 90%) are transferred from your solicitor to the seller’s solicitor’s account.

We will release the keys once the money has cleared in the seller’s account.

Congratulations, you are now the legal owner of your new home!

The constant aim of At Home Property is to offer our Clients the very best advice at all times. With this in mind we know that some properties by their nature will benefit from being presented to buyers via the competitive and emotional environment of an auction room.

“If we don’t take care of our customers then someone else will…”

Why At Home Property?

We carry a vast amount of knowledge because the Directors of At Home Property have a long and successful business relationship with BBC1’s ‘Homes Under The Hammer’ and vastly experienced South-West auctioneers, Graham Barton MRICS and Scott Gray AssocRICS of Clive Emson Auctioneers.

Graham and Scott’s knowledge of property disposal is second to none covering the residential and commercial sectors along with development opportunities as well as both agricultural and amenity land lots.

To put some numbers on it, Graham alone has sold an estimated quarter of a billion pounds worth of property and land from the rostrum in his career in the West Country and both he and Scott are very proud of the fact that no other auction company sells more lots by Auction for Clients in Devon and Cornwall. A particularly spectacular fact is that 85% of their Clients achieve a legally binding exchange of contracts on the disposal of their property or land within just twenty business days of the commencement of marketing.

We would encourage any seller who may for example have property that requires modernisation, refurbishment, perhaps has structural or lease issues or a property with a rental income or protected tenants to contact At Home Property for an informal and free discussion regarding the use of Auction to dispose of a property.

There are eight Auctions throughout the year so make contact with At Home Property where we can provide some initial advice before arranging for Graham or Scott and a Director from At Home Property to meet with you to discuss how together we can achieve you a successful and binding sale, sooner rather than later.

Land and Investments

Whether its putting you in touch with landlords looking to sell on their ready made investment, or identifying properties ripe for development and with scope for a suitable yield, At Home Property can potentially help.

Are you looking to invest in property or land in the next few years?

Why At Home Property?

As we have a large portfolio of rental properties and landlords, we are always talking to people considering selling but perhaps not actually making their investments visible to the general public. It is these possible opportunities we can make you aware of and with our experience of managing the actual property we will know very well how suitable an investment it would be for your situation.

So, if you are thinking of investing in your future in what is widely regarded as the safest place you can put your money, then don’t hesitate to call us and arrange for a coffee and an informal chat.
